ANALISIS HUKUM TERHADAP PELANGGARAN PEMINDAHAN PAKSA WARGA SIPIL DAN PENDUDUKAN ILEGAL DALAM KONFLIK ISRAEL DAN PALESTINE BERDASARKAN KONVENSI JENEWA IV TAHUN 1949

Abstract

The Israel-Palestine conflict is one of the longest and most complex conflicts in modern history, with various violations of international humanitarian law occurring, particularly regarding the forced displacement of civilians and illegal occupation. Based on the Fourth Geneva Convention of 1949, such actions are prohibited and categorized as war crimes.
This research employs a normative juridical method with a legislative approach and case study. Data was collected through analysis of international legal documents and reports from various human rights organizations. This study focuses on the application of international humanitarian law principles in the Israel-Palestine conflict and the effectiveness of law enforcement against these violations.
The results of the research indicate that Israel systematically carries out the forced displacement of Palestinian civilians, illegal occupation, and various forms of human rights violations, including restrictions on access to basic needs such as water, education, and healthcare. These violations contradict the provisions of the Fourth Geneva Convention and other international laws. Efforts to enforce the law by the international community still face various obstacles, especially in the implementation of sanctions against responsible parties.
This research emphasizes the importance of the active role of the international community in upholding humanitarian law and providing protection for Palestinian civilians. Concrete steps are needed, including political pressure, economic sanctions, and strengthening the role of the International Criminal Court to prevent similar violations in the future.
