Ardini Rakhmania Ardan arniardan@gmail.com Haris Djoko Saputro harisdjokosaputro@gmail.com <p>Penelitian ini mengkaji kewajiban hukum penyedia <em>foundation models</em> dengan <em>systemic risk </em>dalam kerangka pengaturan <em>General Purpose Artificial Intelligence</em> (GPAI) berdasarkan <em>European Union Artificial Intellegence Act</em> (EU AI Act). Menggunakan metode penelitian hukum normatif dengan pendekatan <em>statute approach, conceptual approach,</em> dan <em>analytical approach,</em> penelitian ini menganalisis dua permasalahan utama: pertama, apakah pengaturan kewajiban hukum penyedia <em>foundation models</em> dengan <em>systemic risk </em>dalam EU AI Act sudah proporsional; dan kedua, bagaimana penerapan <em>risk-based regulation theory</em> dalam EU AI Act untuk mengidentifikasi kategori risiko sistem AI yang relevan dan adaptif dengan kondisi Indonesia. Hasil penelitian menunjukkan bahwa secara normatif kerangka pengaturan EU AI Act sudah proporsional dalam tujuannya, namun mengandung tiga kelemahan signifikan: ambang batas 10²⁵ FLOPs rentan dimanipulasi secara teknis, mekanisme audit independen berisiko menjadi formalistik, dan rezim sanksi tidak memiliki insentif kepatuhan preventif. Bagi Indonesia, meskipun penggunaan AI saat ini didominasi kategori risiko minimal dan risiko terbatas, sistem AI berkategori risiko tinggi sudah beroperasi aktif di sektor keuangan, kesehatan, penegakan hukum, dan ketenagakerjaan tanpa pengawasan memadai, menciptakan kesenjangan perlindungan yang serius terhadap hak-hak fundamental. The research aims to reveal the forms of social injustice, the marginalization of indigenous communities, and the power relations represented in the film. This study employs a qualitative approach using library research and content analysis methods. Primary data were obtained from the film’s scenes, dialogues, visual symbols, and narrative structure, while secondary data were derived from books, academic journals, and scholarly documents related to land conflicts, human rights, and Rawls’ theory of justice. The findings indicate that <em>Pesta Babi</em> portrays land conflict as a humanitarian issue closely associated with the loss of cultural identity, the right to life, and the spiritual space of indigenous Papuan communities. From the perspective of justice as fairness, the study demonstrates that the state has not been able to provide distributive justice, protection of fundamental rights, and equal participation for indigenous peoples. Imam Gusthomi farrasalbin@gmail.com <p>Perkembangan aset kripto sebagai instrumen investasi digital menimbulkan tantangan baru dalam sistem perpajakan nasional, khususnya terkait pengenaan pajak atas capital gain dan potensi terjadinya capital flight. Indonesia melalui PMK Nomor 68/PMK.03/2022 telah mengatur pemajakan transaksi aset kripto, sedangkan Singapura menerapkan kebijakan yang relatif lebih fleksibel terhadap keuntungan investasi aset digital. Penelitian ini bertujuan untuk menganalisis perbandingan pengaturan pemajakan capital gain aset kripto di Indonesia dan Singapura serta implikasinya terhadap potensi perpindahan modal. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan komparatif. Hasil penelitian menunjukkan bahwa perbedaan rezim perpajakan antara Indonesia dan Singapura berpotensi memengaruhi keputusan investor dalam menentukan lokasi transaksi aset digital. The Indonesian judiciary strives to achieve a judicial system that is simple, swift, and cost-effective, which is realized through the simplified litigation mechanism. However, Islamic economic disputes require unique legal considerations, namely the integration of positive law (PERMA) with Islamic Sharia values. This study aims to analyze the implementation, evidentiary process, and judicial reasoning in the Magetan Sharia Court Decision No. 15/Pdt.GS/2024/PA.MGT. The research design employed was a normative legal study using a single-case study approach. Data were collected through a review of primary court decisions and analyzed qualitatively and normatively using legal interpretation. The findings indicate that the GS mechanism is effectively applied in murabahah disputes, where the evidentiary process is simple and expeditious. The judge’s reasoning demonstrates a balance between positive law and the principle of al-wafa bil ‘uqud, and even rejects claims for damages deemed excessive. The development of corruption cases shows that criminal proof no longer relies solely on witnesses and conventional documents, but also on electronic documents, transaction data, state loss audits, expert testimony, digital records, and a series of inferences connecting evidence to the elements of the offense. The main issues examined in this article are the legal patterns surrounding the use of modern evidence in representative corruption cases from 2020 to 2025 and how the worthiness of such evidence can be analyzed through the traceability of process, integrity of evidence, validity of examination methods, rationality of the relationship between evidence and the elements of the offense, and protection of the defendant’s rights. This research uses a normative legal method with statutory, conceptual, and case approaches. The research materials were obtained through document study of legislation, ICW reports, KPK reports, documents from relevant organizations, and literature on the law of evidence. The findings show that formal recognition of electronic evidence is insufficient to guarantee the evidentiary worthiness of evidence in corruption cases. Although Indonesia possesses significant investment potential, various obstacles, such as overlapping regulations, policy disharmony between the central and local governments, and inconsistencies in law enforcement, continue to generate uncertainty for investors. The study aims to analyze investment barriers from the perspective of Gustav Radbruch’s concept of legal certainty, identify forms of legal uncertainty following the reform, and formulate appropriate legal strategies. The method employed is a normative legal approach with a descriptive-analytical framework based on a literature review. The findings demonstrate that the reforms introduced by the Job Creation Law have not yet fully resolved legal uncertainty, particularly in terms of implementation and institutional coordination.
