ANALISIS HUKUM IZIN PERUMAHAN MUNJULJAYA RESIDENCE DAN KEBIJAKAN ZONA LSD PEMERINTAH
Abstract
The rapid population growth in Indonesia has driven a high demand for housing development, especially in urban areas. However, this demand often clashes with agricultural land protection policies, notably the Protected Rice Fields (LSD) zoning. This article analyzes the legal conflict between legally issued housing permits and the subsequent implementation of LSD zoning, focusing on the case of Munjuljaya Residence in Purwakarta. Using a normative juridical method, this study examines the inconsistency between the permits issued through the OSS system and the LSD designation by the Ministry of ATR/BPN. The findings reveal violations of legal certainty, lack of procedural justice, and absence of participatory policy-making. This study recommends harmonization between licensing systems and spatial planning policies to ensure fairness and protect public and business interests.
