Penegakan Hukum Penenggelaman Kapal Asing Terkait Illegal, Unreported, Unregulated Fishing Di ZEE Dalam Unclos 1982

Abstract

Illegal, Unreported, Unregulated Fishing is a foreign term established in 2008 by the United Nations and categorised as a world crime. Illegal is a fishing activity without a permit from the relevant country, Unreported is a fishing activity without reporting the amount of catch, Unregulated is a fishing activity in an area that does not have conservation measures.

This research is conducted to find out the provisions of national and international law that regulate the sanctions of IUU Fishing conducted in the Indonesian EEZ, as well as the responsibility of the state that conducts IUU Fishing by using a normative juridical approach, the research specification used is descriptive analytical, with the stages of research, namely library research, data collection techniques using document studies, and using qualitative analysis methods.

The conclusion of the research related to the sinking of foreign vessels regulated in Law No.45/2009 on Fisheries is indeed a strict sanction from the Indonesian government, while according to UNCLOS 1982 related to the sanction of sinking is not clearly regulated but it is allowed as long as it does not violate the principles of international law in the form of principles of justice and principles of human rights.
