PERLINDUNGAN HAK ULAYAT MASYARAKAT HUKUM ADAT TERKAIT PENGADAAN TANAH UNTUK PROYEK STRATEGIS NASIONAL DITINJAU DARI PP 39/2023
Abstract
Customary land is the land area under the control and utilization of land to which customary law communities also have customary rights. However, in reality, land acquisition for the public interest with the development of national strategic projects still has many discrepancies in its implementation. This has triggered rejection from customary law communities for the development of national strategic projects in their territory by not respecting their existence and customary rights. The purpose of this research is to discuss the protection of customary rights of indigenous peoples related to land acquisition for national strategic projects. This research uses a normative juridical approach. The results of the research explain the mechanism for implementing project development in land acquisition and providing compensation to indigenous peoples in socialization, which is stated in the Government Regulation on the Implementation of Land Acquisition for the Public Interest.
